HR Compliance – What You Need to Know if You Have 50+ Employees!

DID YOU KNOW: As of January 1, 2016 businesses with 50 or more employees must meet the Employment Standard component of the Accessibility for Ontarians with Disabilities Act (“AODA”).

In order to help improve accessibility for people with disabilities, your organization must comply with a number of  legislative requirements pertaining to HR compliance, impacting the following areas of your business:

  1. Recruitment and Selection
  2. Internal Communication
  3. Developing Talent
  4. Workplace Information
  5. Accommodation Plans
  6. Return to Work

The Ontario Ministry of Economic Development, Employment and Infrastructure has already started targeted audits to ensure compliance with these new requirements. In particular, employers should be prepared to:

  • File compliance reports
  • Show the development of policies related to accessibility
  • Provide training to employees
  • Develop individual accommodation and return to work plans
  • Make information and resources accessible to all employees

A recent Toronto Star article highlights just how many employers aren’t meeting the Employment Standards Act requirements. In a recent inspection blitz, 238 employers were found to be in breach of the legislation, with 175 related to public holiday pay, 129 related to vacation pay, and 61 related to overtime pay.*
